Federal Court Interlocutory Order - (DP World Melbourne)

The Federal Court has today made interlocutory orders in respect of a matter involving the Construction, Forestry, Maritime, Mining, and Energy Union (the MUA) and DP World Melbourne Limited (DP World).  

Pursuant to this order, the MUA, whether by its officers, employees, delegates, agents or howsoever otherwise, is restrained from organising, encouraging, procuring, or inducing any person employed by DP World to perform crane or straddle operations at the West Swanson Terminal (Relevant Employees), to:

  1. perform work in a manner different from that in which it is customarily performed, the result of which is a restriction or limitation on, or a delay in, the normal rate of movements by a crane or straddle or other performance of work; or
  2. adopt a practice in relation to work, the result of which is a restriction or limitation on, or a delay in, the normal rate of movements by a crane or straddle or other performance of work.

The MUA hereby states that action of the kind referred to in subclauses (a) and (b) above (and clause 1 of the attached Order) must cease and not occur, and is not authorised by the MUA.
